Welcome to Nabbed. By creating an account or using our platform in any way, you agree to these Terms of Service ("Terms"). Please read them carefully. If you do not agree, you must not use Nabbed.

1. About Nabbed

Nabbed is a peer-to-peer online marketplace that enables private individuals ("Sellers") to list secondhand and designer clothing and accessories for sale to other users ("Buyers"). Nabbed is a marketplace facilitator, not a seller. Nabbed is not a party to transactions between Buyers and Sellers and does not own, inspect, or take title to any items listed on the platform. All contracts of sale are formed directly between the Buyer and Seller.

"Nabbed" refers to the platform operated at this website. Nabbed is not yet incorporated as a limited company. Contact: team@nabbedarchive.com.

2. Eligibility & Accounts

You must be at least 18 years old to create an account or use Nabbed. By registering, you confirm that you meet this requirement. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at team@nabbedarchive.com if you suspect unauthorised access.

You may not create multiple accounts, transfer your account to another person, or use another person's account. You must provide accurate, current, and complete information when registering and keep it updated.

3. Buying on Nabbed — prices and payment

Prices are in pounds sterling. The price shown on a listing is the total you pay, and it includes an amount towards payment processing. That amount is a flat rate, and it may be higher or lower than the processing cost of any particular transaction. Nothing further is added at checkout.

Stripe processes payments. We don't see or store your card number, and we don't hold your money: it sits within Stripe's regulated environment until the sale completes, and Stripe pays the seller.

Sellers set the amount they receive. Where a seller's earnings pass £1,000 in a calendar year, we charge 5% on their sales after that point (see the Seller Terms). It comes out of the seller's proceeds and is never added to your price.

Nabbed Premium is billed monthly in pounds. Cosmetic items and titles are included with it and aren't sold separately.

4. Listing Rules

When listing items on Nabbed, you agree that:

  • All items are authentic and not counterfeit, replica, or otherwise infringing.
  • Descriptions are accurate, honest, and include all relevant defects, flaws, or damage.
  • Photos are of the actual item being sold and are not misleading stock images.
  • You are the rightful owner of the item or have the right to sell it.
  • Items comply with all applicable UK laws and regulations.
  • The listed condition (e.g. "New with Tags", "Good") accurately reflects the item's state.

You are solely responsible for the authenticity and accuracy of your listings.Nabbed does not verify the authenticity of items listed on the platform. If a Buyer disputes an item's authenticity, the Seller bears responsibility. Listings that violate these rules will be removed and may result in account suspension.

5. Relisting

Nabbed allows users to "relist" (resell) items originally listed by another Seller at a higher price. When a relist is purchased:

  • The original Seller is responsible for shipping the item directly to the Buyer.
  • The original Seller receives the original listing price.
  • The relisting user receives the markup (relist price minus original price).
  • If the original item is sold or delisted before the relist is purchased, the relist is automatically deactivated.
  • Relisting is not permitted on items that are themselves relists.

By relisting an item, you represent that you have reviewed the original listing and believe it complies with these Terms. You accept that disputes with the Buyer regarding the item are ultimately the responsibility of the original Seller.

6. The sale contract and delivery

Prices and payment are covered in section 3 (Buying on Nabbed — prices and payment).

By completing a purchase, you enter into a binding contract with the Seller. Nabbed processes the transaction on behalf of both parties but is not itself a party to the contract of sale.

It is the Seller's responsibility to ship the item promptly once an order is placed. Delivery timescales, shipping costs, and logistics are the Seller's responsibility unless otherwise stated.

7. Prohibited Conduct

You must not:

  • List or sell counterfeit, fake, replica, or unauthorised goods.
  • Harass, abuse, threaten, or impersonate other users.
  • Send spam, unsolicited messages, or engage in phishing.
  • Manipulate prices, engage in shill bidding, or collude with other users to distort the marketplace.
  • Artificially inflate your XP, ratings, engagement metrics, or any platform statistics.
  • Attempt to circumvent any security measure, rate limit, or access control.
  • Use automated bots, scrapers, or scripts to access the platform without written permission.
  • Conduct any transaction outside the platform to avoid paying legitimate fees.
  • Upload or share illegal content, content that infringes third-party rights, or content involving minors.

8. Intellectual Property

Nabbed and its logo, design, features, and software are the intellectual property of the platform operators. You may not copy, reproduce, or create derivative works from any part of Nabbed without express written permission.

By uploading photos or content to Nabbed, you grant us a non-exclusive, royalty-free, worldwide licence to use, display, and reproduce that content on the platform and in marketing materials relating to the platform. You retain ownership of your content and may delete it at any time (subject to legal retention requirements).

9. Limitation of Liability

Nabbed provides the platform "as is" and makes no warranties about the accuracy, availability, or suitability of the platform or any items listed on it. To the maximum extent permitted by law, Nabbed will not be liable for:

  • The quality, safety, legality, or authenticity of items listed or sold.
  • Any loss arising from a Buyer-Seller dispute.
  • Any indirect, consequential, or punitive loss.
  • Platform downtime, data loss, or unauthorised access resulting from events beyond our reasonable control.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other matter that cannot be excluded under English law.

10. Termination

Nabbed reserves the right to suspend or permanently terminate your account at any time, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or otherwise acted in a way that harms other users or the platform. You may request deletion of your account at any time by emailing team@nabbedarchive.com. We will erase your personal data within one month of your request, except for records we are required by law to keep (for example transaction and tax records), which we retain for the applicable statutory period and then delete.

11. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, unless you are a consumer resident in another jurisdiction and applicable local law provides you with more favourable rights.

12. Changes to These Terms

We may update these Terms at any time. If we make material changes, we will notify you via the email address associated with your account or via a prominent notice on the platform. Your continued use of Nabbed after the effective date of updated Terms constitutes your acceptance of those changes.
